2. WEBSITE GOAL
The website www.freesleeping.com offers their users a virtual space to make the house, apartment or room exchange possible without any money transfer involved between the parties.
The exchange enables to inhabit the property exclusively during the dates and time already established.
In the case that a user cannot do the exchange with another user during the stated dates, FREESLEEPING offers the opportunity of “paying” to inhabit another user's house through a score system, developed on point 9.
To make use of the space delivered by FREESLEEPING, interested customers should subscribe and pay one hundred dollars (100USD) annually.
3. TERMS AND CONDITIONS OF USE
The access and use of the website www.freesleeping.com is voluntary and can be done under two modalities, as a visitor or as a user. In both cases, it implies the acceptance of terms and conditions agreement, as well as the services offered.
A visitor makes reference to a person who enters the website and uses it without subscribing as a user.
To have access and subscribe as a user the person has to:
• Be over 18 years old.
• Not having restricted capacity, and be able to act as the curator by its name and its representation.
It is under parents or tutor's responsibility the use of the website if the users happen to be underage.
4. FREESLEEPING RESPONSIBILITIES AND GUARANTEES

Also, FREESLEEPING is freed from any damage or incident may occur in the property during the exchange.
That is why, users can only claim each other for any incident, quitting the possibility of civil, criminal, business or management liability against FREESLEEPING or even the website's owners.
Visitors as well as users recognize and agree that FREESLEEPING site cannot be available due to maintenance work, safety or other external situations, such as a power cut or an internet interruption.

5. CHANGES MADE TO THE “TERMS AND CONDITIONS” AGREEMENT
Considering the uses, practice on home exchanges as well as the technological advances, Freesleeping reserves the right to modify the terms and conditions agreement, and accepting that users and visitors have this reservation possibility.
Every modification made, will be notified in the terms and conditions agreement tab, where it will appear the date of the last modification. It is an obligation for users and visitors to check the changes made.
Each modification that affects the right and obligations of the users will be there for thirty (30) days since the date of the last modification made. If the user rejects the modifications, it is free to cancel the subscription to the service.
As regards visitors, the modifications are accepted by them as soon as they use the website, otherwise the application will be denied.
FREESLEEPING's target is to offer both, users and visitors an agile, useful and safe website. In this sense, some service elements or webpage design might change at any time without need of notification, just accepting the modifications on the use of the website.
6. REQUIREMENTS AND CONDITIONS FOR SUBSCRIBERS
To subscribe as a FREESLEEPING user and once the quality of user is acquired, the user must fulfil the following requirements:
- Have reached the eighteen (18) years old and not have a restricted capacity, and be able to act as the curator for its name and representation.
- Only can be subscribers for personal use and not for commerce. It is forbidden for commercial use.
- To have access to FREESLEEPING and make use of its services, users should have internet connection.
- Have a valid e-mail address, where the acceptance of the subscription will be sent.
- Notifications will be sent to the given e-mail address or through the notifications published on the “Terms and Conditions Agreement”.
- The user must give valid and exact information about it, and inform any possible change.
7. SUBSCRIPTION
The subscription to FREESLEEPING services works once there is an acceptance to the Terms and Conditions Agreement and the according payment to the subscription.
ACCEPTANCE
The acceptance is made when there is a click on “accept” during the registration process. This behavior is enough to demonstrate the agreement between all parties.
PAYMENT
In order to be able to make use of FREESLEEPING services, a one hundred dollars (100USD) payment has to be done. The payment can be done through:

Once the payment is done, and FREESLEEPING checked on that, an email will be sent with detailed information regarding the method of payment, sum and date.
8. SUBCRIPTION ANNULMENT
The user can cancel at any time yet FREESLEEPING will not repay.
The subscription will be for the lapse of one (1) year. Once expired, the subscription should be done again.
If there is an annulment or an expired date, users will lose their access to FREESLEEPING services.
9. POINTS SYSTEM "Happy Points"
Users can gain points for different actions:
• For signing up, you will be automatically rewarded with 500 points.
• Stating the house value:
- Identity validation with a selfie and a photo of your ID card, passport or driver's license will give you 10 points.
- When uploading more than 5 photos of the house you will be rewarded with 10 points.
- When completing the item “general description” - 10 points.
- When completing the “availability” section with updated info for availability for mutual exchange, exchange with points and any other type of exchange the user will get 5 points.
- For every checked item in the “distinctive features” - 5 points for each one.
- For each “house rules” item - 5 points.
- Locating the property on the map – 10 points.
- Adding “favorite destinations” – 5 points.
- For every review left by the host – 10 points.
- For every review left by the guest – 10 points.
• "Help points" system:
In the case a subscriber wants to acquire points, he can do it by paying for them according to the following scale:
500 points → USD50
1000 points → USD90
2000 points → USD170
5000 points → USD400
10000 points → USD700
10. USERS DUTIES AND OBLIGATIONS
- To make the property offer, the user must count on the authorization/right over the property so as to make the exchange.
- Hire a damage, fire, steal insurance for the property.
- Publish a detailed description of the property that must match to the images uploaded to the website. Discriminatory or illegal content cannot be pronounced.
- Users have to act in order to make the exchange possible, listening and responding to the other party needs.
- Can't upload virus to the system or overload it with different actions that may affect the correct functioning of it.
- Confidentiality duty of all the information published on the website.
- Must not act in a manner that defames FREESLEEPING.
- The property must be in such conditions that does not put on risk future inhabitants.
- Once the exchange is done, the new inhabitants turn into the guards of the property. The user is the only responsible of any damage made to the house, but not if there is an obvious damage made out of the obvious usage of the commodity.
- If a pet is allowed, it should not put on risk the inhabitants' lives. The user have to sign the specific contract that makes it the only responsible of any harm caused.
- With the subscription, the user is responsible of keeping the safety and confidentiality of user's name, password and all the activity carried on the website.
- The user have to identify the people who are travelling with, giving the information that FREESLEEPING asks for.
- Users can denounce FREESLEEPING for any inadequate, illegal content that goes against the Service Conditions.
11. EXCHANGE AGREEMENT
If there is a possibility in which two users can carry on the exchange, they will have an “exchange agreement”.
This agreement will contain:
- Detailed addressed localization of the property (street, number, apartment number, room or house). Every detail that facilitates its location.
- Date and time of the check in and check out of the exchange.
- Property data that coincides with the one published by each user.
- Users data declared on the FREESLEEPING subscription.
- Rights and duties between the users.
- Acceptance of the agreement that is made by clicking the “accept” during the exchange process.
12. PRIVACY POLICY, USE OF IMAGES AND DATA
Here it is how FREESLEEPING is going to use the data provided by the users.
In order to register as user it will be necessary that people offer the correct information so as to identify the property in exchange as well as the user.
The data and images published will be intended to future users or visitors of the webpage. The data will be also used to complete the agreement exchange contract.
Users can have access to their data at any time and change it.

15. EXCHANGE ANNULMENT
If a member of a party cancels the exchange without a good reason, it will be penalized by FREESLEEPING. Such punishment consists of the elimination of the user's account as well as not be able to continue surfing the website. No refund will be made.
A righteous cause can be user's death or disease, partner or children's death or damages in the property that cannot be repaired before the exchange date.
FREESLEEPING has no responsibility over the party affected by the annulment. Any complaint should be done between the users.
